Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Silverback Care wellness check-in service (“Silverback Care,” “we,” “us”). By creating an account or using the service, you agree to these Terms.
1. What Silverback Care does
Silverback Care places wellness check-in phone calls to a person you designate (a “Care Recipient”) and shares summaries, transcripts, and alerts with you (the “Caregiver”). Depending on your plan, calls are placed by a real person matched to your Care Recipient’s native language, or by an AI-generated voice as the more affordable option. Silverback Care is a wellness and companionship tool. It is not a medical, healthcare, monitoring, or emergency service (see Section 7).
2. Eligibility & your account
- You must be at least 18 years old and able to form a binding contract.
- You are responsible for the activity under your account and for keeping your login secure.
- You agree to provide accurate information, including the Care Recipient’s phone number and details.
3. Your authority over the Care Recipient (important)
By adding a Care Recipient and scheduling calls, you represent and warrant that:
- You have a genuine caregiving relationship with the Care Recipient and the authority to arrange these calls on their behalf;
- You have obtained the Care Recipient’s consent to (a) receive calls from Silverback Care, including AI-generated calls where applicable, and (b) have those calls recorded and transcribed; and
- You have the authority to receive the Care Recipient’s wellness information through the service.
You agree to indemnify Silverback Care for claims arising from your lack of such authority or consent (see Section 10).
4. Recorded calls & AI consent
- Calls are recorded and transcribed for the purpose of providing the service. On certain plans, calls are conducted by an artificial / AI-generated voice.
- At the start of each call, Silverback Care discloses to the Care Recipient that the call is recorded and, where applicable, AI-generated. Continuing the call indicates consent.
- You acknowledge that telephone consent laws vary by jurisdiction and that some states (including California) require the consent of all parties to record a call. You are responsible for ensuring such consent exists for the Care Recipient you designate.
5. Acceptable use
You agree not to use Silverback Care to:
- Call any person who has not consented, or whom you are not authorized to contact;
- Harass, deceive, defraud, or harm any person;
- Violate any applicable law, including telemarketing, robocall, or wiretapping laws;
- Interfere with or attempt to disrupt the service or its security.
6. Fees
Paid plans are billed monthly in advance at the prices shown on our Plans page. You can cancel at any time; cancellation stops future billing and takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law. Every plan includes a free 30-minute consultation before you commit.
7. No medical advice; not an emergency service
Silverback Care does not provide medical, nursing, or professional health advice, diagnosis, or treatment, and is not a substitute for professional care or for monitoring by a qualified person. Silverback Care is not an emergency service and cannot detect, report, or respond to emergencies. In an emergency, call 911 (or your local emergency number). Never rely on Silverback Care for urgent or life-safety needs.
8. Third-party services
Silverback Care relies on third-party providers to function, including telephony and voice-AI providers, Google sign-in, SMS providers, and cloud hosting. Your use of the service is also subject to those providers’ terms, and we are not responsible for their acts or omissions.
9. Disclaimers & limitation of liability
The service is provided “as is” and “as available,” without warranties of any kind, to the fullest extent permitted by law. To the maximum extent permitted by law, Silverback Care will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from missed, delayed, or failed calls, inaccurate transcripts or summaries, or reliance on the service. Our total liability is limited to the greater of the fees you paid to us in the twelve months before the claim or USD 100.
10. Indemnification
You agree to indemnify and hold harmless Silverback Care from any claim or liability arising from your use of the service, your breach of these Terms, or your representations about authority and consent in Section 3.
11. Termination
You may stop using the service at any time. We may suspend or terminate access if you violate these Terms or to protect the service or others.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted here with an updated “Last updated” date; continued use after changes means you accept them.
13. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules.
